This represents an increase from the 12% figure recorded during the previous year.

On Tuesday, the Danish manufacturer filed a complaint in the U.S. District Court located in New Jersey. The suit contends that Eli Lilly misled shoppers through deceptive promotional materials suggesting its products outperform those offered by Novo Nordisk.

“In both cases, the ads are maliciously and deceptively false because Lilly knowingly cites outdated clinical trials that compare the highest doses of the Lilly medicines to lower doses of Novo Nordisk’s medicines,” according to the lawsuit.

According to the filing, Novo Nordisk highlights that the FDA recently sanctioned enhanced dosages of its medications, designed to improve glycemic control and facilitate weight reduction. Despite this, the complaint argues that Eli Lilly failed to incorporate these updated figures into its marketing assertions. Furthermore, while Lilly notes the presence of a stronger Wegovy dosage within minor footnotes, the plaintiff characterizes these references as nearly imperceptible and unclear.

Responding to the accusations, Eli Lilly expressed confidence in its messaging strategy. A spokesperson told CBS News that the campaign reflects honesty and clarity, relying on robust scientific findings.

“It is truthful, it is transparent, and it is grounded in the most direct scientific evidence available — exactly what patients deserve,” the company said. “We will continue to focus on the science and defend against this lawsuit vigorously.”
