“Mr. Bergal refused lawful orders to exit his vehicle. He then accelerated his vehicle, smashing into two of our government ICE vehicles, and then weaponized his vehicle and proceeded to accelerate going toward other officers,” Charles said.
DHS also said the agent who fired did not know that a 5-year-old child was in the rear seat. That account was disputed by Ruth Hilaria, a deli worker near the scene, who said she saw the vehicle moving away from the ICE agents and heard the child cry for his father afterward.
Child was physically well, congressman says
Rep. Adriano Espaillat visited the child at the hospital and said the boy appeared physically well while watching cartoons. The child’s mother said he was frightened and continued to repeat what happened.
“He was watching cartoons on TV,” Espaillat said. “I just gave him high five, and we had a nice conversation, and he seemed to be physically in good shape. But the mom told me that he was very afraid and kept repeating what occurred.”
The child’s presence has heightened concerns about enforcement operations in densely populated New York City neighborhoods, where relatives and bystanders can be close to quickly developing confrontations.
Federal custody dispute follows shooting
Bergal’s attorneys appeared in federal court in Lower Manhattan on Friday, arguing that he was arrested without a valid warrant and seeking his release from federal custody. He was later transferred to a federal detention facility outside New York state.
Mayor Zohran Mamdani said he tried to secure Bergal’s transfer the previous night and spoke with President Trump and DHS Secretary Markwayne Mullin. Mamdani said no agreement was reached.
